The incompetence of Melella's government plunged TotalEnergies into a political and diplomatic conflict

The stopover of the British oil tanker VS Promise in Ushuaia transformed a routine foreign trade operation into a political and diplomatic crisis. The vessel left the country with only a third of its cargo capacity after cutting short a stay planned until mid-September, placing the country's largest gas operator under scrutiny by the State Prosecutor's Office and the Malvinas Question.

The French company is a key player in the Fuegian energy matrix and one of the country's main gas producers.

If the tanker VS PROMISE had not docked at the commercial pier in Ushuaia early on Monday, August 24, its presence at the Río Cullen monobuoy would have gone unnoticed, as happened for three decades with hundreds of ships chartered by operators in the sector to export hydrocarbons from the Austral Marine Basin and onshore deposits.

However, the statement of condemnation from Governor Gustavo Melella, the response from presidential spokesman Adrián Ravier, and the public intervention of the Foreign Ministry fully exposed the oil consortium at the center of a highly sensitive social and geopolitical conflict .

The assets at stake of the largest operator in the far south

For the French company Total Austral (TotalEnergies) —the main operator in the province along with Pan American Energy (PAE) and Harbour Energy (formerly Wintershall Dea)—this public overexposure is not harmless. The company is a key player in Tierra del Fuego's energy matrix and one of the country's main gas producers, strategically operating five consolidated fields in the Austral Basin:

The firm also has current investment commitments exceeding USD 530 million following the extension of hydrocarbon concessions granted by the Province itself, a scheme that includes the contribution of the bulk of Tierra del Fuego's current income through the settlement and collection of royalties that are shared with the municipalities.

Economic loss due to dead freight and risk of kidnapping

The ship's unexpected departure revealed a direct logistical impact for the shippers:

1.  The original operational plan: The VS PROMISE was scheduled to remain in the northern Fuegian area until approximately September 15 , anchored while waiting for the Cullen land tanks to accumulate the crude oil necessary to carry out a second pumping operation and complete its capacity.

2.  The cost of dead freight: By leaving the area with only 22,464 tons (approximately 165,000 barrels) , the vessel sailed with just one-third of its nominal capacity (500,000 barrels). Time or voyage charter party contracts stipulate high daily rates in dollars; sailing to the Gulf of Mexico with 67% of its holds empty will represent a considerable financial loss that the contracting company will have to absorb.

3.  Preventive withdrawal decision: Faced with the political escalation, the requests for information from the State Prosecutor and the reports of complaints under the Gaucho Rivero Law or the Solanas Law regime, it seems that the shipping company or the operator itself pushed to withdraw the ship from Argentine jurisdictional waters to avoid the latent risk of a precautionary measure of seizure or preventive judicial embargo.

 • Cargo actually carried out: ~165,000 barrels (22,464 tons).

The door to the past opened by the State Prosecutor of Tierra del Fuego

The real unintended consequence for the Melella administration and the oil companies lies in the historical rearview mirror activated by the State Prosecutor's Office , headed by Virgilio Martínez de Sucre .

By formally demanding that the Executive Branch present the records of moorings, pilotage, and dispatches “for this year or previous periods,” the investigation will force the opening of the books from the last few decades of the Provincial Port Authority and the Secretariat of Hydrocarbons. It will reveal whether the systematic entry of oil tankers flying the UK flag or flags of convenience linked to the British Crown to transport crude oil from the Tierra del Fuego coast has been a common practice, condoned by successive administrations.

Although it was reported that the Secretariat of Hydrocarbons sent a formal letter to TotalEnergies requesting clarification, the conflict has already crossed provincial borders. In its attempt to undermine the national government's intervention in the port of Ushuaia through the media, the Tierra del Fuego government not only exposed the workings of provincial crude oil exports but also dragged its main strategic partner into a crisis of costs, official audits, and explanations that are only just beginning.
